Circuit Court of Jefferson County, Mississippi Grants Motion to Sever Claims Against Insurer Represented by CWP

On December 29, 2011, Judge Lamar Pickard granted a Motion to Sever filed by CWP member Lee Ann Thigpen on behalf of The Travelers Indemnity Company of America. The Court ruled that the insured’s third-party claims against Travelers for defense and indemnity were distinct events from those involved in the underlying toxic tort action. The motion was granted despite the fact that little Mississippi authority exists concerning the legal issues raised in the parties’ briefing. CWP’s success in this matter ensured that the insurance coverage claims against its client would not be tried alongside unrelated and potentially confusing toxic tort claims.
