Tennessee Court of Appeals Affirms $7.2 Million Verdict

The Tennessee Court of Appeals has affirmed a $7.2 million subrogation verdict obtained by CWP members Jim Warren and Alexandra Markov in 2010. The October 2010 trial stemmed from a fire at an insured municipal energy facility.

The Defendants appealed the verdict arguing that the trial court committed reversible error with regard to several rulings, including the exclusion of the Defendant’s primary expert and the grant of an adverse inference instruction. The Court of Appeals affirmed the trial court in all respects. A copy of the appellate opinion is available here.
